Chapter 7 Bankruptcy
Allows the consumer over a three or four month period of time to wipe out most debts by having the United States Bankruptcy Court issue a Discharge of Debt. This option should be chosen by the consumer who is overwhelmed by debt and wishes to obtain a fresh start. A consumer filing for Chapter 7 Bankruptcy can keep his/her property that is exempted by federal or state law. We will advise you on what property you can protect from liquidation or sale.

What Is Dischargeable Debt?

Unsecured or Secured Debt?
Most debt falls into two categories: unsecured debt and secured debt. Bankruptcy attacks these debts in different ways, depending on whether you file Chapter 13 or Chapter 7. For the most part, unsecured debt is the most susceptible to debt discharge. However, you can also attack secured debt through bankruptcy. What About Debt That Is Not Discharged?
It is possible that you will not be able to discharge all of your debt through bankruptcy. For example, if you want to keep your car, you will have to keep your debt associated with that car. However, most people find that, by having most other debt eliminated, remaining debt becomes much easier to manage
